INPS (National Institute of Social Security) Extends Income Support to Non-Citizens Awaiting Residence Permit Renewal

Foreign nationals who are in the process of renewing their residence permits in Italy are eligible for various income support benefits, as confirmed by the National Institute of Social Security (INPS). This provision includes entitlements to unemployment benefits such as Naspi and Dis-Coll, as well as other subsidies like the asylum bonus and nursery bonus.


In a recent clarification, prompted by a consultation with the State Attorney's Office, INPS issued Message No. 1589 on April 22, 2024. This message references Article 9 bis of Legislative Decree No. 286/1998, known as the Consolidated Immigration Act. It underscores that foreign workers, who are awaiting either the issuance or renewal of their residence permit, can legally reside within the country and continue their employment until they receive a notification from the Public Security Authority. This notification must specifically indicate if there are reasons that may prevent the issuance or renewal of the residence permit.


Further detailed in the Ministry of the Interior’s Directive PROT.11050/M(8) dated August 5, 2006, these regulations ensure the continuity of a regular residence status for foreign nationals. This means that those who have applied for a renewal can remain in Italy with full rights, as the document issued by the office certifying the renewal request suffices as legal proof.


The directive also clarifies that even if the process takes longer than the standard twenty-day timeline for renewing a residence permit, this delay does not impact the legality of the foreign national's stay or their associated rights. The validity of these rights remains uninterrupted until the renewal process is officially concluded, except in cases where the renewal is denied or the permit is revoked or canceled.


Based on these guidelines, INPS mandates that its regional offices must proceed with the payments for the requested benefits for eligible applicants awaiting renewal of their residence permits. These payments are subject to retraction in the case that the renewal application is ultimately denied.


Through these measures, INPS aims to support the stability and economic well-being of foreign workers in Italy during their permit renewal process, ensuring that administrative delays do not hinder their right to financial support..
