Recruiting Non-EU Workers for 2023: Steps Before December Click Day

Introduction:

When recruiting non-EU individuals residing abroad for the year 2023, it's crucial to follow specific procedures to ensure a smooth and compliant hiring process. Before the "click day" in December, there are two essential steps to complete:


1. Request Personnel Verification from the Job Center:

- To initiate the process, you must submit a request to the competent Job Center (CENTRO PER L’IMPIEGO). The submission method should adhere to the guidelines provided by the respective employment/job center.

- This request is designed to assess the availability of workers in Italy with the required qualifications and characteristics.


2. Obtain Work Authorization at the Immigration Desk (Sportello Unico per l'Immigrazione):

- It's important to note that this step is not required if you intend to hire through a flussi decree.


Requesting Personnel from the Job Center:

To request personnel verification from the Job Center, you'll need to use a specific form available here. The Job Center will process your request and make it public.


Verification of Worker Unavailability:

The verification of worker unavailability is considered complete in the following scenarios:

- If 15 working days have passed since the request without a response from the Job Center, as stipulated in article 9, paragraph 3 of the Prime Ministerial Decree of 29 December 2022 [referred to as the "flow decree"(decreto flussi)].

- If, after the selection interview, you determine that the worker proposed by the Job Center is unsuitable for your requirements.

- If 20 working days have elapsed since the request, and the workers recommended by the Job Center fail to appear for the selection interview you requested, or if they fail to provide a valid reason for their absence.


Communication with the Job Center:

Promptly inform the Job Center of the following:

- The outcome of the selection interview.

- Any relevant information for managing the request.

- If the worker proposed by the Job Center did not attend the selection interview and failed to provide a valid reason for their absence.

- If the worker proposed by the Job Center was deemed unsuitable for the selection interview.

- If the worker proposed by the Job Center rejected the contractual proposal.


After conveying any of the above reasons to the Job Center, you can proceed to request a work permit for hiring a foreign worker from abroad or a foreigner present on the national territory without a regular residence permit.
